What You Need to Know About Texting and Driving Accidents

Posted By: Ward Black Law

Texting and driving is a rapidly growing trend that claims far too many lives each day. Whether traveling at high speeds on the interstate or cruising down a familiar road, using a phone behind the wheel is a dangerous distraction. Not only that, it is against the law in North Carolina. Sadly, this doesn’t stop most, as a study found that 77% of young adults say they feel confident that they can safely text while driving. This notion of invincibility is a true epidemic and causes nearly 25% of all car crashes. Have you been involved in a serious accident where texting and driving was cited as the cause? You may be able to file a claim against the negligent driver, seeking compensation for your damages.

Expect the Unexpected: What To Do At The Scene Of a Car Accident

Posted By: Ward Black Law

car accident blogWith nearly 10 million car accidents happening every year, the odds of living a collision-free life are not in any
driver’s favor. If you’ve been in an accident, you already know that emotions running high can make it difficult to focus on the technical and legal steps that should immediately follow. Most people (unless seriously injured) swap insurance information and aim to get out of Dodge as quickly as possible. While you probably just want the experience to be over, neglecting crucial steps can cost you in the weeks to follow. With years of experience handling car wreck claims, the attorneys at Ward Black Law have some practical steps to help you protect yourself after an accident.

Here’s a handy roadmap to help you navigate the aftermath of an accident:

  1. Remain at the scene. If no one is injured, move your vehicle out of the path of traffic. However, you should never leave the scene of an accident before speaking with law enforcement. Doing so can result in serious consequences.
  2. Call the police. The officer will create an accident report, so be sure to write down his name and agency (eg, city police, sheriff, highway patrol) to obtain your copy later.
  3. Do not admit fault. When talking with the other driver, avoid making explicit comments about the accident until the police arrive.
  4. Exchange information with the other driver. From their insurance card and licence, you should record the following:
    • Name
    • Address
    • Telephone number
    • Name of car insurance company
    • Policy number
    • Name, address and telephone number of insurance representative to contact about the accident
    • License plate number and the state in which the car is registered
    • Suspicious about the information provided? You can always call the insurance company from the scene of the accident to verify coverage before the police officer leaves.
  5. Take pictures. Take pictures of your car, their car, any debris, the road and anything unusual.

After the Accident

In the days following a car accident, there are several steps you need to take to ensure you are protected if claims are filed against you. These steps can also be used to make sure you receive compensation for any claims you file.

Cold Weather and Commercial Trucks, an Accident Waiting to Happen

Posted By: Ward Black Law

winter tractor trailer crashAccording to the the U.S. Department of Transportation, one in every 10 deaths in highway accidents involves a tractor trailer. In 2012, more than 3,000 people died in tractor trailer accidents, more than half of whom were occupants of cars or other passenger vehicles. In the winter season, cold weather often contributes to tractor trailer accidents. Considering that a  an 18-wheeler truck often weighs 20-30 times more than the average passenger vehicle, braking is  far more difficult in icy or rainy weather.  If a driver is fatigued, is inattentive, or the brakes have not been adequately maintained, the potential for accidents increases exponentially.

The Lawyer’s Perspective on Personal Injury Cases

Posted By: Ward Black Law

Lawyers seldom see their clients’ personal injury cases the same way their clients see their cases.  This phenomenon typically has little to do with the client or the facts of the case – really, we want do to all we can to help our clients.  Rather, this divergence in viewpoints comes from a lawyer’s legal training and experience.
