Expect the Unexpected: What To Do At The Scene Of a Car Accident

car accident blogWith nearly 10 million car accidents happening every year, the odds of living a collision-free life are not in any
driver’s favor. If you’ve been in an accident, you already know that emotions running high can make it difficult to focus on the technical and legal steps that should immediately follow. Most people (unless seriously injured) swap insurance information and aim to get out of Dodge as quickly as possible. While you probably just want the experience to be over, neglecting crucial steps can cost you in the weeks to follow. With years of experience handling car wreck claims, the attorneys at Ward Black Law have some practical steps to help you protect yourself after an accident.

Here’s a handy roadmap to help you navigate the aftermath of an accident:

  1. Remain at the scene. If no one is injured, move your vehicle out of the path of traffic. However, you should never leave the scene of an accident before speaking with law enforcement. Doing so can result in serious consequences.
  2. Call the police. The officer will create an accident report, so be sure to write down his name and agency (eg, city police, sheriff, highway patrol) to obtain your copy later.
  3. Do not admit fault. When talking with the other driver, avoid making explicit comments about the accident until the police arrive.
  4. Exchange information with the other driver. From their insurance card and licence, you should record the following:
    • Name
    • Address
    • Telephone number
    • Name of car insurance company
    • Policy number
    • Name, address and telephone number of insurance representative to contact about the accident
    • License plate number and the state in which the car is registered
    • Suspicious about the information provided? You can always call the insurance company from the scene of the accident to verify coverage before the police officer leaves.
  5. Take pictures. Take pictures of your car, their car, any debris, the road and anything unusual.

After the Accident

In the days following a car accident, there are several steps you need to take to ensure you are protected if claims are filed against you. These steps can also be used to make sure you receive compensation for any claims you file.

Ask An Attorney Day is Friday, March 6

statewide service dayThe North Carolina Bar Association has declared its annual “Statewide Service Day” to provide pro bono services on Friday, March 6, 2015. It will include statewide “ask an attorney” phone numbers at which North Carolina lawyers will provide legal information for free for one day. The day will be highly promoted as a community service, and will hopefully serve as a stepping stone towards getting more attorneys to become pro bono volunteers.  Our very own Janet Ward Black and Afi Johnson-Parris will be participating.

This service, promoted as “Ask an Attorney Day” allows any North Carolinian to call a toll free number between 7 a.m. and 7 p.m. that day to receive free legal advice from attorneys from all areas of practice who are set up at several call centers across the state.

The North Carolina Bar Association continues to embrace the “4ALL” campaign initiated under the presidency of Janet Ward Black in 2008, setting a formula through which the NCBA commits to making legal services available to all North Carolinians, focusing on those at or below the poverty level.  The slogan is an updated twist on the Pledge of Allegiance, “one nation, under God, with liberty and justice for all.”

Give a Little Christmas Cheer: Ward Black Law’s 7th Annual “Toys For Tots” Drive

It’s almost that time of year again- Jack Frost is starting to nip at our noses, Christmas tree stands are popping up and everywhere you look there are miles of decorations. Christmas is officially around the corner. While that statement might bring a twinkle to your eye and some items to your shopping list, the sad reality is that approximately 16.4 million American children are currently living in poverty.

Lending A Helping Hand

This Christmas, Ward Black Law would like to announce their continued partnership with the U.S. Marine Corps Reserve to sponsor the seventh annual “Toys For Tots” drive in the Greensboro, N.C., community. “Toys For Tots” is an organization whose mission is to “help the less fortunate children throughout the United States experience the joy of Christmas.” They also strive to “unite all members of local communities in a common cause for three months each year… and contribute to better communities in the future.”

The kick-off event for the 2014 “Toys For Tots” drive will be held on December 5th in front of the Ward Black Law offices from 7am to 6pm and is open to anyone who would like to donate to this worthy cause. Just bring new, unwrapped toys for children from infants to 12-year-olds to one our donation sites before December 15th.

Monetary gifts to “Toys For Tots” are also appreciated, but not required.  Donated toys will be delivered to needy children in the Triad area by volunteer Marines before Christmas Day.

Defective Hip Implant? What the Stryker Settlement Means For You

An estimated 300,000 people undergo hip replacement surgery annually. If you are among this population, you likely know that some major implant systems have been recalled over recent years. In 2012, Stryker Orthopaedics recalled their Rejuvenate Modular and ABG II Modular-Neck Hip Stems after the products suffered a very high failure rate. Due to metal-on-metal corrosion, patients can experience swelling, pain, tissue damage, metal poisoning, bone deterioration and other devastating health issues. The Stryker company stopped sales and production immediately, but – for many patients – it was too late, and costly revision surgery was the only option.

Mesothelioma Awareness Day: September 26, 2014

In 2004, Mesothelioma Day was established to raise awareness about one of the most deadly and unrecognized forms of cancer. Over the past ten years, organizations have joined together to shed light on the devastating effects, and to raise money for life-saving treatments. As we approach Mesothelioma Day 2014, Ward Black Law and organizations all over the world hope to get people talking about this rare cancer. The lawyers of Ward Black Law have represented victims of asbestos exposure, including Mesothelioma for 25 years.

What is Mesothelioma?

Mesothelioma, caused solely by exposure to asbestos, develops in the thin cell layer that lines the body’s internal organs. Currently, there are three recognized forms of Mesothelioma: pleural, peritoneal and pericardial. Each affects different organ linings from the heart to the lungs, with pleural mesothelioma being the most common form. Diagnosis is difficult and often delayed since the disease can lay dormant for years before causing symptoms. When symptoms do arise, they can be mistaken for other illnesses until they grow to be more severe. Common symptoms include lower back, side and chest pain, discomfort, breathlessness, difficulty swallowing, persistent coughing, fever, weight loss and fatigue.

Many people at risk are unaware of potential symptoms of mesothelioma. People who are most at risk include miners, construction workers working with asbestos products, military veterans, 9/11 first responders and any spouse or family member in consistent contact with someone working in with asbestos-laden areas. Although no cure exists, treatment options are being developed to help prolong the lives of patients. As Mesothelioma Day continues to grow, more people are becoming aware of the harsh realities associated with the disease, and many are helping raise money for treatments.
