WBL Now Handling Veterans Disability Cases

Ward Black Law announces the implementation of a new practice area assisting United States military veterans in obtaining disability benefits through the Veterans Administration. With the VA experiencing a very high number of new claims and an estimated half-million claims in backlog status at the start of 2013, Ward Black Law is stepping forward to help veterans through the difficult and time-consuming claims appeal process.
 
Attorney and U.S. Air Force veteran Afi Johnson-Parris has joined Ward Black Law to lead this new practice area for the firm.  Johnson-Parris is accredited by the Veterans Administration to represent veterans in the filing and appeals process for obtaining disability compensation. Ward Black Law attorney Gerard H. Depuy Hip Implants – More News

An internal analysis by Johnson and Johnson, the makers of the recalled Depuy hip implants has been publicly released through court documents and reveals that the company projects that as many as 40% of the implants used will fail within 5 years in the patients who received it.

According to an article in today’s New York Times, “About 93,000 patients worldwide received an A.S.R., about one-third of them in the United States.” Assuming that 40% of them could fail, the A.S.R. Hip Implants (Articular Surface Replacement) could fail with five years for over 12,000 Americans who received the implant.  The implants were recalled by Johnson and Johnson in 2010.  So far about 9,000 cases have been filed between federal court in Ohio and state court in California.  The first cases go to trial this week in California.

Update: What You Need to Know Right Now About the Fungal Meningitis Outbreak. And Fungal Meningitis Lawsuits.

fungal-meningitis-picWhat began as a constellation of seemingly isolated cases of deadly infections has become a raging nationwide outbreak of a rare fungal meningitis linked to contaminated epidural steroid injections. The  disease continues to spread, and the latest numbers from the U.S. Centers for Disease Control are staggering: 510 illnesses from fungal meningitis and peripheral joint infections, 36 deaths. Cases have occurred in multiple states: Florida, Georgia, Idaho, Illinois, Indiana, Maryland, Michigan, Minnesota, New Hampshire, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Rhode Island, South Carolina, Tennessee, Texas and Virginia. The disease has apparently claimed one life in North Carolina.

Contributory Negligence May Bar Your Claim

North Carolina is one of only four jurisdictions in the United States, including Virginia, Maryland and the District of Columbia, where an injured party’s claim against a careless driver may be completely barred by his or her own negligence. For example, if another driver is inattentive, runs a red light and collides with your vehicle, a jury could conclude that you “contributed” to your injury by entering the intersection when you knew, or should have known, that it was dangerous to do so.

The Prodigal’s Father

 It’s 8:50 am Wednesday, August 31, 2011.  I’ve been up since 4. I let my two dogs out to “use the tree,” as we call it, at 4:50 am.

My German Shepherd Treva came bounding back within the typical 90 seconds. My fifteen year old, deaf, cancer-ridden miniature schnauzer, Watson, did not.  And he still hasn’t come home.
